This agreement
These terms are between you and With Intelligence Inc., a Florida corporation (“we”, “us”), and they govern your use of Operate With Intelligence (“OWI”, the “Service”) at www.operatewithintelligence.com. Using the Service means you accept them.
Where we have signed a separate written agreement with you, that agreement governs and these terms fill the gaps.
What the Service is
OWI is software for operating a business — reviewing what is actually happening, deciding what to do, and keeping a record of why — delivered alongside consulting work performed by people at OWI.
The two are not the same thing. The software shows what was found and what was approved. The judgement in a report is human work, done by a named person.
Accounts and eligibility
You must be at least 18 and able to enter a contract, and you must be authorised to act for the business you are using the Service for. Access is granted to named people; keep your sign-in to yourself and tell us promptly if you think it has been used by someone else.
Acceptable use
You agree not to:
- break the law with it, or use it to harm anyone;
- connect a system you are not authorised to connect, or upload material you have no right to share;
- attempt to reach another client’s information, or to work around the access controls;
- resell the Service, or use it to build a competing product from our material.
Your data stays yours
Everything you put into the Service, and everything read from a system you connect, remains yours. You grant us the licence needed to run the Service for you — to store it, process it, prepare your reviews and reports, and show it back to you and to the people at OWI working on your engagement. Nothing wider.
We do not sell it, and we do not use it to train general-purpose AI models.
The Service itself — the software, its design and our methods — remains ours.
AI proposes; a person decides
AI is used to help read material and draft findings. It does not decide anything, and it does not act on your behalf.
No report reaches you, and no message, post or record is sent or published anywhere, without a person at OWI approving that exact content first. The Service has no automatic publishing and no ability to send mail on your behalf.
AI output can still be wrong. Anything material should be checked against your own records before you act on it, which is why every approved statement in a report carries the evidence it rests on.
No guarantee of outcomes
We do not guarantee any particular business result — no revenue figure, no valuation, no saved hours. What we commit to is the work: reading what is really there, saying what we found, and being clear about what we could not establish.
Nothing in the Service is legal, tax, accounting, investment or medical advice.
Connected services
When you connect Google or another system, that provider’s own terms continue to apply to it, and we are not responsible for how they run their service. You can withdraw any connection at any time; parts of the Service that depended on it will stop working, which is the honest consequence rather than a penalty.
You confirm that you are entitled to grant the access you grant — that the account is yours or you are authorised to connect it, and that doing so does not breach an agreement with that provider or an obligation to anyone whose data sits in it.
What each connection permits is set out in the Privacy Policy. In summary, and in every case when and if you connect it:
- Google — connected today. Read-only: mail, calendar, and only the individual Docs or Sheets you pick, never your Drive.
- Jobber — OAuth. We read jobs, quotes, invoices and client records. We do not create, change or delete anything there.
- QuickBooks Online — OAuth, for the one company you authorise. We read accounting data and do not write invoices, bills or payments. Each company is a separate connection.
- Quo — an API key you issue. We read phone and messaging records for follow-up and reviews, and we do not send anything through it.
Jobber, QuickBooks Online and Quo are connectors we are building. Naming them here fixes the limits before anything is connected; none of them is reading anything until you connect it.
Availability
We aim to keep the Service running and will not promise a specific uptime figure we have not measured. The Service is provided “as is” and, to the extent the law allows, without warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of liability
To the fullest extent permitted by Florida law, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told such damages were possible.
Our total liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits.
Ending it
You may stop using the Service at any time and ask us to close your workspace. We may suspend or end access if these terms are breached, if it is necessary to protect the Service or another client, or if we stop offering it — with reasonable notice unless the situation makes that impossible.
On termination you may ask for a copy of your data and ask us to delete it. See the Privacy Policy for how that works.
Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The courts of Florida are the venue for disputes.
Changes and contact
We may update these terms; the effective date above moves when we do, and material changes are told to people using the Service. Continuing to use it after a change means accepting it.
